New Board of Nursing Requirements for Self-Reporting Arrests

Effective October 1, 2019, licensees of the North Carolina Board of Nursing must report to the Board within thirty days any felony arrest or indictment, any arrest for driving while impaired or under the influence, and any arrest or indictment “for the possession, use, or sale of any controlled substance.”  2019 N.C. Sess. Laws 180 § 9 (to be codified at N.C. Gen. Stat. § 90-171.37C(e)).  Failure to report is a violation and subjects the person to discipline.

 Other statutory changes include a clearer description of the Board’s authority to subpoena patient records and other documents, id. § 5 (to be codified at N.C. Gen. Stat. § 90-171.23(b)(24)), and a new provision making Board investigative information non-public, id. § 9 (to be codified at N.C. Gen. Stat. § 90-171.37C(a)).
